I have used the RLA deed of Guarantee many times for the initial fixed term AST without any problems. But I have never had to enforce it for subsequent tenancy agreements or put it in front of a judge. I am looking at using the Guarantee against a guarantor who guaranteed a 12 month ast 3 years ago. That first fixed period went fine. As did the 2nd. Problems came with the rd ast in the third year. The tenant left the property in month 3 of a 6 month ast(this was the 3rd ast at the same property).
How confident are you in paragrpahs 6 & 7 holding up before a judge? I am worried about the Guarantor saying he only guaranteed the first ast and the judge showing sympathy.
